On September 28, 2021, the District Court of Debrecen announced a verdict in the case of the accused who wanted to send a booklet soaked with a new psychoactive substance to a relative staying in the penitentiary institution.
At the preparatory hearing, the prosecutor made a moderate motion on the content of the sentence – 80 days of confinement – if the accused made a statement of confession and waived his right to a trial. The man admitted to committing the crime in accordance with the indictment and waived his right to a trial, which he accepted by court order.
The trial court found the accused with a criminal record guilty of attempting to abuse a small amount of a new psychoactive substance, and sentenced him to 75 days in prison.
According to the facts established by the court, on August 4, 2020, the accused sent a letter through one of his post offices in Debrecen to his relative in Márianosztra Prison, where the man was serving a custodial sentence. The defendant placed a handwritten booklet in the envelope, which was soaked with a quantity of new psychoactive substance. The mailed consignment also arrived at the penitentiary on August 10, 2020, however, during the inspection of the letter, the guards found the drug-soaked sheet, so it was not delivered to the recipient.
The judgment of the Debrecen District Court did not become final, and both the prosecutor and the accused and his counsel reserved three working days to file a statement of appeal.
