NMHH imposed a fine of 48 million HuF on UPC service provider for serious and conscientious violations of basic EU and domestic legislation. For almost two months, the service provider has made it impossible to access OLS, another service provider.The National Media and Communications Authority (NMHH) imposed a fine of 48 million HuF on UPC Hungary’s Telecommunication Ltd. after making impossible for their subscribers to reach On Line System Informatics and Consulting Ltd. (OLS) both on mobile and fixed telephones between the 25th of July and the 18th of September in 2017.
According to the NMHH’s decision, UPC’s market behavior has seriously violated the basic EU and national legislation on the provision of telephone services, which should ensure that all subscribers have access to all numbers.
Between the 25th of July and the 18th of September in 2017, for nearly two months, UPC’s fixed telephone and mobile phone subscribers were not provided access to OLS numbers or access numbers transmitted to the service provider, which means that OLS subscribers were unavailable for UPC subscribers. The situation became more serious due to the fact that UPC directed its subscribers, deliberately misleading them, to the other service provider’s costumer service, claiming that the failure was caused by OLS’s network. However, the investigation revealed that unsuccessful calls were not caused by a network failure, but UPC itself forbade the access of OLS subscribers, probably because they had had an unsettled argument with the service provider before.
Authorities found that approximately 22,000 phone numbers were not available and more than 38,000 calls failed, which involved more than 4,000 UPC subscriber.
