The Debrecen District Prosecutor’s Office has criminalized and prosecuted a man who, out of jealousy, constantly observed his ex-partner and misused her personal data.
The accused had a cohabiting relationship with the victim for nearly four years, but their relationship ended in March 2019, and the victim later got into a new relationship.
Even before the woman moved away, the accused installed spyware on the IT devices used by the victim in order to scan her personal information, messages, usernames and passwords, and then backed up the data.
The man wanted to restore his relationship with the victim, so between April and July 2019, he searched 457 times on a cell phone and sent an email to the woman. In some messages, the defendant threatened his ex-partner with death, to whom this caused serious fear. During the investigation carried out by the Berettyóújfalu Police Headquarters, the suspect was subject to coercive measures.
In addition to the above, the defendant uploaded confidential photographs of the victim to various Internet sites, locked the woman’s cell phone based on passwords obtained by spyware, changed her profiles on social media sites to upload confidential photographs of the victim to expire.
The defendant also accessed the e-mail account and community profile of his ex’s new partner and posted a dating ad on behalf of the man. These actions of the accused portrayed the victims in a morally negative situation, the woman also had to change her job.
The Debrecen District Prosecutor’s Office prosecuted the accused, who admitted his act in part, for illegal data acquisition, harassment, violation of the information system and other crimes in the Debrecen District Court. In the indictment, the district prosecutor’s office filed a motion to impose a prison sentence and an additional sentence of disqualification from public affairs, as well as to confiscate the computer equipment used for the offense. The district prosecutor’s office also proposed in the indictment the specific amount of the sentence in case the accused confesses to his deed at the preparatory hearing of the district court and waives the trial.
