The Debrecen Tribunal sentenced the 44-year-old accused to 7 years in prison and 7 years in public order for attempted homicide, misconduct, and harassment. The Debrecen Tribunal found that the accused could not be released on parole.
The court ruled that the man has been convicted of harassment, theft, and bodily harm. The man was still attached to his ex who had in the meantime married the victim and she was living in a small town in Hajdúság.
The accused appeared in front of their house on several occasions in the spring and summer of 2019 and forcibly tried to persuade the woman to continue her life with him. After the woman firmly rejected him each time, the accused blamed the husband for his failures. He sometimes threatened to kill both of them. For this reason, the police also took action against him.
It was in June that the accused and his ex-partner attended a family event on the occasion of the graduation of their common son. After the woman returned home, the defendant followed her to her house in the evening. He went into the yard, and when the woman’s husband called for him to leave, he punched him in the face with such force that the man in the chair fell backward. Fearing further attacks, the victim took a small ax. He repeatedly called for him to leave, grabbing his neck with one hand and trying to push him out of the patio. However, the drunk defendant resisted. They began to linger, during which both men fell. At this point, the attacker picked up the 1.5-kg ax with a half-meter handle on the ground and struck the forehead of the defenseless man with great force once with the degree of the device. From the force of the blow, the man’s head began to bleed heavily. His wife and son, who were also present, intervened immediately and prevented further abuse. The woman notified the ambulance service. The victim underwent life-saving surgery at the hospital as he suffered an impressive fracture of the left forehead and internal hemorrhagic injury to the skull. His serious injuries were healed by the persistence of permanent physical disability.
The defendant did not plead guilty during the proceedings. He defended himself by saying that he grabbed the ax for fear of being attacked. He considered the act of harming the victim to be an accident. He said what happened was just self-defense, an accident. Together with his counsel, he appealed for acquittal and for a lesser classification and mitigation of the crime.
The prosecutor’s office proposed aggravating the sentence, citing a number of aggravating circumstances. According to the Debrecen General Prosecutor’s Office, the duration of the imprisonment and the auxiliary sentence were indeed too low. Even the aggressive nature of a man sentenced to long-term imprisonment, even for the crime of killing as a juvenile, is proportionate to the imposition of more severe imprisonment.
The appeals are decided by the Debrecen Arbitration Board.
