Young Men Beat and Robbed a Man in Debrecen

The Debrecen Appellate Chief Prosecutor’s Office has requested the aggravation of prison sentences and the recognition of the defendant’s guilt in the attempted murder with particular cruelty of a man who was beaten and robbed on the street.
According to the verdict, the defendants, who are related to each other, were drinking with relatives, the victim, and the victim’s partner at a property in Debrecen on May 2, 2022. In the evening, the defendants got into an argument with the victim, whom they then expelled from the house. The man left and waited nearby for his partner. When the older defendant, a 22-year-old, noticed this, he approached the victim and, after a brief argument, struck him without any reason. The man fell backward from the blow and lost consciousness. The younger defendant, a 17-year-old, then arrived and also struck the unconscious victim, after which both defendants brutally and persistently assaulted the helpless man while repeatedly searching his pockets. They only stopped the assault when one of the defendants noticed a surveillance camera.

The Debrecen Court found the young men guilty of attempted murder and robbery, sentencing them to four years in a juvenile detention center and eight years in prison, respectively.

Both the prosecution and the defendants, along with their defense attorneys, appealed the decision. The prosecution sought a reclassification of the crime and harsher punishment, while the defendants and their attorneys sought acquittal, a different legal classification, or a reduction of the sentences.

The Debrecen Appellate Chief Prosecutor’s Office argued that the defendants should have known that the blows and kicks to the victim’s head could have been fatal. With this awareness, they continued to strike and kick the head of the helpless man lying on the ground.

Given this, the prosecutor’s office claimed that the legal assessment of the defendant’s actions was incorrect and requested the appellate court to reclassify the crime and impose a proportionate punishment based on the nature and manner of the act.

The Debrecen Court of Appeal will make the final decision in the case.
