The Debrecen General Court held a decision at a public meeting on January 9, 2024, in a criminal case whose defendant committed a crime in Debrecen at a pedestrian crossing at Böszörményi Road. A pedestrian died as a result of the accident.
In the case of negligent causing of a fatal road accident, the District Court of Debrecen changed the judgment of 8 February 2023 on a seized crime and otherwise upheld the first instance judgment.
The man was sentenced to 2 years in prison and banned from road driving for 2 years to 6 months, which had been taken from the commission to the declaration of the final judgment.
According to the court’s facts, the accused was driving a car in Debrecen on September 6, 2021, on the Böszörményi Road, a busy, two-lane road. At the time of the accident, traffic was sparse, and the traffic light on the road section gave a flashing yellow signal. Four people were traveling in the vehicle, the seat belt was used by everyone.
Due to the extreme carelessness of the driver, he noticed very late that a vehicle had stopped in front of the designated pedestrian crossing, where the 63-year-old was passing through a normal pace. The driver hit the pedestrian with a significant detection delay, 1.3 seconds before the collision, at 62 km/h. As a result of the accident, the victim suffered such serious, life-threatening injuries that he died on the spot.
In his oral reasoning, Dr. Antal Nagy, President of the Council, said that the case was limited, the court could not examine the facts and the legitimacy of certification in the first instance judgment. The court found that the Court of First Instance had fully complied with the criminal procedure for him and declared the accused guilty. The Court of First Instance revealed all circumstances, as well as the danger to the safety of the accused, inherent in the personality of the accused, as well as the mitigating circumstances to his benefit. The tribunal reflected on the suggestion that the pedestrian crossing was not properly painted and that it covered its visibility. In this circle, it was emphasized that the accused, traveling on the road section he knew, moved to the pedestrian crossing, exceeding the speed limit of 50 km/h, which was shown by the yellow flashing light of the signaling light. This in itself has shown that the scene of the accident should be approached with special caution. From this point of view, it can be stated that the accused has led very high negligence to the accident, the imperative violation of the traffic regulations, which was evaluated by the court during the imposition of the penalty.
Dr. Antal Nagy emphasized that it was a heavy aggravating circumstance that the accused had committed a deliberate traffic offense, drunk driving, and criminal proceedings in progress so that the accused would have been even more likely to be cautioned.
The court’s judgment has become final.
