The Debrecen Public Prosecutor’s Office brought charges against the construction manager, who ordered his employees to work irregularly, for the offense of reckless endangerment in the course of employment, causing permanent disability.
The accused works as a construction manager for a construction company in Debrecen, which in April 2020 completed the construction of a four-story apartment building in downtown Debrecen.
On April 28, 2020, around 08:00 a.m., a pallet of roof insulation material arrived at the construction site, which had to be delivered to the roof of the four-story house under construction. The defendant arranged for the insulation material to be lifted onto the roof with a crane and entrusted the victim, who worked there, to hang the pallet from the crane’s hook on the roof of the building.
When the goods were placed on the gently sloping roof from the crane, the 280 kg building material moved on the pallet after being unloaded and fell on the victim’s leg. As a result of the accident, the man suffered a fragmentary fracture of the middle third of the right thigh with displacement, which took more than eight days to heal. As a result of his injury, the victim had, among other things, difficulty walking with permanent disability and a difference in limb length.
The accused construction manager violated the relevant construction industry, safety, and occupational health and safety regulations, as it should not have been possible to load the insulating material on the slightly sloping roof with a crane, and the work of two people would have been required to load it onto the roof. The defendant gave instructions to carry out irregular work despite the fact that the victim had warned him of the dangers before starting the work.
The investigation was carried out by the Debrecen Police Department.
The District Prosecutor’s Office in Debrecen brought charges against the defendant, who confessed to the crime, for the offense of reckless endangerment in the course of employment, causing permanent disability, at the District Court in Debrecen. In the indictment for issuing a criminal sentence, the district prosecutor’s office proposed that the district court, based on the content of the documents, impose a fine on the defendant without conducting a trial.
